The full text below is binding.
1. Scope
1.1 These terms apply to the use of KollegPass at kollegpass.de and in the web app (PWA), with or without an account.
1.2 KollegPass is provided by [COMPANY_NAME], [COMPANY_ADDRESS] ("we", "us"). More details are in the legal notice.
1.3 KollegPass is meant for private exam preparation.
1.4 When you buy a pass, the buyer terms of Dodo Payments also apply (section 2). Your mandatory statutory rights as a consumer always remain unaffected.
1.5 KollegPass is currently not intended for people whose residence or habitual residence is in Russia or Belarus. You may not use KollegPass or buy passes from there.
2. Contracting parties and the role of Dodo Payments
2.1 Usage contract with us. When you create an account, you conclude a contract with us on the use of KollegPass. It covers your account, the content, the features and the rules. If you use KollegPass as a guest, these terms apply to your use where they fit.
2.2 Purchase contract with Dodo Payments. Paid passes are sold to you by Dodo Payments ([MOR_LEGAL_NAME], [MOR_ADDRESS]) as reseller ("Merchant of Record"). Dodo Payments is your contracting party for the purchase. Dodo Payments receives the payment, calculates and pays the VAT, issues the invoice and handles refunds and chargebacks. The buyer terms of Dodo Payments apply to this.
2.3 Service by us. We provide the services included in the pass. After the purchase, we unlock the features of your pass in your account.
2.4 Purchase and use are linked. If the purchase ends, for example through withdrawal or a refund, your paid access ends too. Your free account stays.
2.5 One point of contact. You can always contact us first with questions and problems about passes ([email protected]). We sort it out, together with Dodo Payments if needed.
2.6 Your rights come first. Your statutory rights as a consumer, in particular the right of withdrawal and your rights in case of defects, remain unaffected, even if the buyer terms of Dodo Payments say something else.
3. What KollegPass offers
3.1 KollegPass prepares you for Studienkolleg entrance tests. It includes trainers for the C-Test, grammar, maths, reading, listening and vocabulary, timed mock exams (optionally with stress mode), lessons on mental preparation, an AI tutor and AI feedback on short writing tasks. Weekly ranked tests and leaderboards will be added later.
3.2 KollegPass is a self-study programme. There are no lessons and no supervision by teachers. Tests, analyses and feedback are automated.
3.3 We mention names of tests and institutions only to describe what KollegPass prepares you for. All exercises are our own content. They are not real exam tasks.
3.4 We compile information about Studienkollegs (for example dates and test formats) with care. However, it can change or be out of date. Only the information from the institution itself is binding.
3.5 You need an internet connection and an up-to-date browser. Some features, for example offline use and push notifications, do not work in every browser.
4. Use without an account and with an account
4.1 As a guest you can use the free parts without an account. Your progress is then stored only in your browser. We have no access to it and cannot restore it. If you delete your browser data, it is gone.
4.2 You create an account with Google, Apple or Telegram. There is no password with us. The terms of the respective provider also apply to signing in.
4.3 Each person may have only one account. Your information must be true, especially your age. You may not pass your account on to others. Protect access to your Google, Apple or Telegram account. If you suspect misuse, contact us immediately.
4.4 We may refuse a registration, for example if the age limit is not met or an account of the same person was blocked.
5. Age limits
5.1 You may use KollegPass from age 16. If you are under 16, you may not create an account.
5.2 If you are 16 or 17, you need the consent of your parents or other legal guardians to use KollegPass.
5.3 You may buy passes only if you are at least 18. You confirm this when you buy.
5.4 If we learn that a person under 16 has an account, we delete it. If a minor has bought a pass, the statutory rules protecting minors apply. Parents can then contact us.
6. Plans and scope of services
6.1 Free: diagnostic test (you see your score; the detailed analysis requires a pass), lessons on mental preparation, one full mock exam and limited access to the trainers.
6.2 3-Day Pass (€7): 72 hours of access to all sections, with limits:.
6.3 Pro 3 Months (€39): three months of full access to all sections. Fair-use limits apply to the AI features:. This keeps the service fast for everyone.
6.4 Referral bonus: three days of Pro for free, see section 18.
6.5 We show the exact limits on the pricing page and in the order summary before you buy. The limits at the time of your purchase apply.
7. Prices and payment
7.1 Prices are final prices in euros. They are the same worldwide and include VAT where applicable.
7.2 You pay through the Dodo Payments checkout. You can use the payment methods offered there. Dodo Payments sends you the invoice by e-mail.
7.3 Fees charged by your bank, for example for currency conversion, are not included in the price.
7.4 If a payment is charged back or fails, we may suspend the paid access until the matter is resolved. Please contact us or Dodo Payments before you start a chargeback.
8. How the contract is concluded
8.1 The usage contract is concluded when you create an account and agree to these terms.
- You choose a pass on the pricing page.
- You see a summary with the services, price and duration. You tick the required boxes and click "Continue to payment". Nothing has been bought yet.
- In the Dodo Payments checkout you enter your e-mail address and payment details.
- By clicking the order button (for example "Buy now") you make a binding offer.
- The purchase contract is concluded when Dodo Payments accepts your order. This usually happens with the confirmation directly after successful payment.
8.3 Before the final click you can check and correct all entries. You can cancel the purchase at any time by closing the checkout.
8.4 We store the contract text. After the purchase we send you an e-mail confirmation with the contract details, these terms and the withdrawal information. You can always find the current version of the terms on kollegpass.de.
8.5 You can conclude the contract in German or English.
8.6 We have not signed up to any specific codes of conduct.
9. Duration – no subscription
9.1 Passes are one-time payments. They do not renew automatically and end on their own.
9.2 Your pass starts immediately after the purchase. You expressly request the immediate start during checkout.
9.3 The 3-Day Pass ends 72 hours after the start. Pro 3 Months ends three months after the start at the same time of day. Example: start on 15 January at 18:00, end on 15 April at 18:00. If the day does not exist in the final month, the pass ends on the last day of that month. The time zone is.
9.4 If you buy a pass while another one is still running,.
9.5 You do not need to give ordinary notice, because passes end on their own. Your right to terminate for good cause without notice remains unaffected. You can use the "Cancel contracts here" button at the bottom of every page for this.
9.6 When a pass ends, your account stays on the free plan. Your progress is kept.
10. Right of withdrawal
10.1 As a consumer, you have a statutory 14-day right of withdrawal when you buy a pass. All details are in the withdrawal information.
- When you buy, you request that your pass starts immediately. If you withdraw, you pay a proportionate amount for the time until your withdrawal. You get the rest back.
- For the 3-Day Pass, the right of withdrawal ends when the 72 hours are over.
- You can declare your withdrawal with the "Withdraw from contract" button at the bottom of every page. You do not need an account for this.
- Dodo Payments refunds the money to your original payment method.
10.3 Beyond the statutory right of withdrawal and your rights in case of defects, there is no right to a refund, for example because you did not use a pass.
11. Availability, further development and beta
11.1 We try to provide KollegPass without interruptions. Maintenance and technical problems can briefly limit access. Where possible, we schedule maintenance at times of low use. Your statutory rights in case of defects remain unaffected.
11.2 We keep developing KollegPass. During a paid pass we change features only if there is a valid reason. Valid reasons are, for example, new or changed test formats, security, new technical requirements, legal requirements or improvements. This costs you nothing extra, and we inform you clearly and understandably.
11.3 If a change impairs your access or use more than only insignificantly, we inform you by e-mail in good time beforehand about the change and when it happens. You can then end the contract free of charge within 30 days after the information or after the change (whichever is later). You get a proportionate refund for the remaining period.
11.4 We provide the updates needed to keep KollegPass in conformity with the contract during your pass, in particular security updates.
11.5 We may change or discontinue free features with reasonable advance notice.
11.6 Beta. Before the official launch there is a free public beta version. It is a test version: features can change or disappear, and errors are more likely. We welcome your feedback. There are no paid passes during the beta. During the beta, the provider is the person named in the legal notice.
12. Defects
12.1 If a paid pass is defective, you have the statutory rights. The seller, and therefore the party liable for these rights, is Dodo Payments. Claims against us under the usage contract remain unaffected.
12.2 Please report errors to [email protected] or with "Report a problem" in the app. We fix them within a reasonable time.
12.3 We usually answer complaints within days.
13. AI features
13.1 The AI tutor and AI feedback use the AI model Claude by Anthropic. An AI creates the answers automatically. We label them as AI answers.
13.2 AI can make mistakes. Always check important information, for example dates and rules, with the responsible institution. AI feedback is not an official assessment. Scores are only estimates. The AI tutor does not give legal, visa or health advice.
13.3 Do not enter sensitive data in the AI features (for example about health or religion) and no data about other people.
13.4 Misuse is prohibited. This includes getting around the AI's safety measures, creating harmful content, querying the AI automatically or using it for purposes unrelated to learning. In case of misuse we may restrict your AI use.
13.5 You keep the rights to your own texts. You only grant us the rights we need to provide the AI feature to you. You may use AI answers for your own learning.
13.6 More information is in the AI notice.
14. No guaranteed exam success
14.1 We guarantee neither that you pass a test nor that you get admitted. Results in KollegPass, for example a readiness value or points in mock exams, are internal estimates and not a forecast. Real tests can be structured differently. Each Studienkolleg sets its own rules.
14.2 You are responsible for your application, deadlines and documents.
15. Mental preparation and stress mode
15.1 The lessons on mental preparation are learning content. They are not medical or psychotherapeutic treatment and do not replace it.
15.2 Stress mode simulates exam conditions, for example time pressure and noise. If you feel unwell, stop the exercise. In an acute crisis, contact your local emergency number or a crisis service.
16. Your content: nickname, avatar, photo and name
16.1 You decide what you put in your profile. Your real name and a real photo are optional.
16.2 You may only upload content for which you have the necessary rights. A photo must show you and no other people. More rules, also for nicknames, are in the Community Rules.
16.3 You grant us a non-exclusive, free and worldwide right to use your content to operate KollegPass. In particular, this includes displaying it the way you choose in your settings (profile, leaderboards, result cards). For this we may adapt it technically, for example resize or crop it.
16.4 This right ends when you delete the content or your account. Exceptions are result cards that you have already shared yourself, and backup copies. We delete backup copies after days at the latest.
16.5 We may remove content that breaks these terms or the Community Rules (section 21).
17. Ranked tests and leaderboards
17.1 You need an account for ranked tests.
17.2 Your first three ranked tests are practice rounds. They do not count for the leaderboards.
17.3 You have exactly one attempt for each ranked test. Once you start it, the timer runs. If you close the test early, it is scored with the answers you gave until then. If a technical error on our side occurred, you get a new attempt.
17.4 You see the correct answers only after you finish the test. Do not share tasks or answers while the test is running.
17.5 Fair play. You must solve ranked tests alone and without aids. In particular, the following are prohibited: help from other people, AI tools or translation programs, multiple accounts, account sharing, scripts or bots, interfering with the app or the timer, and sharing tasks and answers.
17.6 Checks. We check results for signs of cheating, for example unusual answer times, conspicuously identical answers from different accounts or signs of multiple accounts. Automated checks only flag anomalies. A human decides on measures.
17.7 Consequences. In case of a violation we may remove your result from the scoring, exclude you from leaderboards for a time or, in serious or repeated cases, suspend your account. We act proportionately, give reasons for our decision, and you can file a complaint (section 21 and Community Rules).
17.8 Visibility. In your settings you choose how you appear in leaderboards: "Nickname only", "Show name" or "Hide me". You can change this at any time. The per-college leaderboard shows which Studienkolleg you are preparing for.
17.9 There are no prizes for leaderboards.
17.10 We may correct errors in scores or leaderboards.
18. Referral programme
18.1 With an account you get a personal invitation link.
18.2 If a new person signs up through your link and, you both get three days of Pro for free.
- The invited person did not have a KollegPass account before and is at least 16.
- The bonus is given only once per new person.
- You get at most bonuses per.
- Inviting yourself, including through additional accounts, is prohibited.
18.4 Share your link only with people you know or in your own channels. Spam, unsolicited mass messages, misleading promises and paid advertising using the KollegPass name are prohibited.
18.5 The bonus has no cash value and is not transferable. It starts. If you already have a pass, the bonus is.
18.6 In case of misuse we may withhold or withdraw bonuses and exclude you from the programme.
18.7 We may change or end the programme for the future. We announce this in advance. Bonuses already earned are kept.
19. Prohibited conduct
When using KollegPass, it is prohibited in particular to:
- spread illegal content or infringe the rights of others (for example copyright, trademark or personality rights),
- insult, threaten, harass or discriminate against others,
- pretend to be another person or institution,
- publish other people's personal data without permission,
- cheat in ranked tests (section 17),
- read out (scrape), copy or redistribute KollegPass content automatically,
- get around security measures, attack or overload the app,
- spread malware,
- use KollegPass for advertising or spam,
- get around usage limits with multiple accounts or technical tricks.
20. Intellectual property
20.1 All KollegPass content belongs to us or our licensors. This includes exercises, texts, audio, design, software and the collection of tasks.
20.2 You receive a non-exclusive, non-transferable right to use the content for your own non-commercial learning for as long as you are allowed to use KollegPass.
20.3 In particular, you may not copy, distribute, sell or make content publicly available, publish tasks or solutions, read out content automatically or use it to train AI systems. Uses permitted by law remain unaffected.
20.4 We reserve the use of our content for text and data mining (§ 44b German Copyright Act, Art. 4 Directive (EU) 2019/790).
20.5 Names like onSET, TestAS, TestDaF, DAAD or uni-assist may be trademarks of their owners. We use them only to describe what KollegPass prepares you for.
20.6 If you send us feedback or suggestions, we may use them free of charge.
21. Moderation, suspension and termination by us
21.1 If you break these terms or the Community Rules, we may: warn you, remove content, reset your nickname, avatar or photo, remove results from the scoring, exclude you from leaderboards or individual features, suspend your account for a time or terminate the contract.
21.2 We act proportionately. We take into account how serious and how frequent the violation is, whether it was intentional and what effects it has. Where possible, we hear your side first.
21.3 For moderation we also use automated tools, for example word filters for nicknames. A human makes suspensions and other important decisions. We inform you about every measure and give reasons. You can file a complaint against it. The procedure is described in the Community Rules.
21.4 We may terminate the free usage contract with days' notice. We cannot give ordinary notice on a running pass.
21.5 Both sides may terminate without notice for good cause. For us, good cause exists in particular in case of serious or repeated violations, for example cheating in ranked tests, payment fraud or illegal content. If we terminate a pass for good cause for which you are responsible, you get back the share of the price for the remaining period to the extent provided by law. Our claims for damages remain unaffected.
22. Liability
22.1 We are liable without limitation
- for intent and gross negligence,
- for damage resulting from injury to life, body or health,
- under the German Product Liability Act,
- to the extent we have given a guarantee or fraudulently concealed a defect.
22.2 In case of slight negligence we are liable only if we breach an essential contractual obligation. Essential obligations are those that make it possible to perform the contract in the first place and on which you may regularly rely, for example providing your paid access. In this case we are liable only for the typical, foreseeable damage.
22.3 Otherwise we are not liable for slight negligence.
22.4 These rules also apply to our employees, representatives and vicarious agents.
22.5 Your statutory rights in case of defects remain unaffected.
23. Termination by you and deleting your account
23.1 You can delete your account at any time in the settings. This ends the usage contract. Download your data first if you want to keep it.
23.2 If you delete your account during a running pass, your paid access ends too. Your right of withdrawal and your rights in case of defects remain unaffected.
23.3 For passes you can also use the "Cancel contracts here" button (section 9.5).
24. Changes to these terms
24.1 We may change these terms for the future if there is a valid reason, for example new features, a new legal situation or security reasons.
24.2 For a new purchase, the version you accept when you buy applies.
24.3 For your existing account, we inform you about the changes at least days before they take effect, in the app and, if we have your e-mail address, by e-mail. The changes apply only once you agree to them. If you do not agree, the previous version continues to apply to you. We may then terminate the free usage contract under section 21.4.
24.4 For a running pass, the version that applied at the time of purchase applies until the pass ends, unless a change is required by law or only benefits you.
24.5 Changes to features are governed by section 11.
25. Governing law and place of jurisdiction
25.1 These terms and all contracts with us are governed by the law of the Federal Republic of Germany.
25.2 If you are a consumer with your habitual residence in another country, you also keep the protection of the mandatory provisions of that country.
25.3 If you are a consumer, you can sue us in the courts of the country where you live. We can sue you only there. Other statutory places of jurisdiction remain unaffected.
26. Consumer dispute resolution
We are not willing and not obliged to take part in dispute resolution proceedings before a consumer arbitration board.
27. Language versions
These terms are available in German and English. The version in the language in which you accepted them applies.
28. Invalid provisions
If a provision of these terms is invalid, the rest of the contract remains valid. The statutory provisions take the place of the invalid provision.
